Workshop and Adventures Terms and Agreements
By being a participant in any of our workshops you are accepting possible risks. Safety is always first and paramount.
Your application shall serve as a full release of all liability and a complete assumption of all risks by you and your heirs, administrator, executor, successors, and assign for all family members.
By accepting the terms of service, you are acknowledging that you are aware that travel, wherever it may be, and by whatever means, involves some possible inherent risk of injury, illness, death, loss, or damage to personal property, which may be caused by acts of nature, negligence or actions of others.
In consideration of, and as part of the payment for your participation in our programs, workshops, excursions, expeditions, other activities, or any program that Brian Riddell Photographics, or their assigns, may be conducting, you are voluntarily and totally releasing Brian Riddell Photographics or their employees, assigns, independent contractors or anyone involved thereof, from any damages, liabilities, costs, injuries whether mental or physical, known or unknown, and by participation you agree to assume all risks whether known or unknown.
You have assumed the responsibility to select an activity appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good physical and mental health to undertake our activity.
By accepting our terms of service, and by your first deposit, you fully certify that you do not knowingly have any physical or other related or unrelated considerations of known disability that would create a risk for you or other participants. We always reserve the rights to request a doctor's statement of good health.
We always reserve the right to cancel any activity and to accept or reject any person as a member of any activity based on our judgment.
You fully acknowledge voluntarily that by traveling to areas that may be remote, foreign, mountainous, wilderness, wild rivers, deserts, and may not be maintained to the standards you are accustomed to and therefore may involve certain and possible additional risks, dangers, and possible inconveniences including, but not limited to, terrorism, forces of nature, wild animals, hotel accommodations, airplane, vehicles, trains, boats, roads, walkways, trails, and other means of conveyance or other unknown risks.
You fully acknowledge that medical services and facilities may not be readily available during all or part of the trip, including medical care, the presence of physicians, and any required medication. We assume no liability for medical care dietary requirements.
Unless accompanied by a parent or legal guardian (and with our written prior approval), you must be at least 20 years old to attend our workshops. Your application signifies your full understanding and agreement that you release and hold without any penalty Brian Riddell Photographics its officers, agents, sponsors, associates, sub-contractors, from any and all and total liability, actions, causes of actions, claims, debts, and demands of every kind whatsoever, known or unknown which may arise in connection with your participation in any of our activities arranged by them without limitation, all total liability, actions, causes of action, claims, debts, and demands related to the negligence of any related individuals.
You will be responsible for researching all pertain pre-trip information. Bringing and carrying all your own photographic equipment, personal items, and appropriate clothing for the workshop and for conforming to standards of dress and personal hygiene.
You are responsible for acting in a manner of consideration for your fellow participants, locations and environments, models, and locations.
You also acknowledge that you understand that travel with a group will involve a degree of compromise to accommodate the diverse desires, travel goals, personalities, and physical abilities of group members.
Also, you understand that while our itineraries are carefully planned and controlled itineraries can change on short notice. There is not a guaranteed schedule of activities, events, or participation, but the schedule represents a guideline and example of events.
Group participants must allow for flexibility and changes deemed necessary by the representative or professional guides. There may be situations beyond our control due to geographic, climatic, weather, physical, or governmental restrictions that will cause further changes in scheduling, timing, locations, and related activities. Understanding this, you further agree that there will be no discounts or refunds for activities changed or eliminated or otherwise affected by such circumstances.
All air transportation and related fees (except as indicated in the original itinerary) activities also noted as optional in the itinerary such as personal gratuities to any and all individuals, unless otherwise noted on the itinerary page. Also, passport and visa expenses, baggage expenses, accident, cancellation insurance, personal expenses (such as laundry), personal telephone calls, meals that are except as indicated on the itinerary, any and all alcoholic beverages; and any other items not specifically noted as included in the original itinerary.
You agree to have any claim, controversy, or dispute relating to the enforcement or interpretation of this document or arising or relating to your registration, participation, or attendance at a Brian Riddell Photographic Workshop, submitted to binding arbitration under the rules and regulations of the Canadian Arbitration Association.
The arbitration shall take place in Cambridge, Ontario Canada. You do hereby fully waive your right to bring an action before a judge or jury in any court and you understand that you have given up your rights to discovery and appeal.
Any award rendered in any arbitration may be made a judgment by any court of competent jurisdiction. You understand that if you refuse to submit to arbitration after agreeing to this provision, you may be compelled to arbitrate under the authority of the Code of Civil Procedure of Ontario.
Cancellation or Change of a Workshop
While Brian Riddell Photographics will make every attempt to operate a trip once confirmed, we do reserve the right to fully cancel or change a trip, at any time due to insufficient bookings and or reasons beyond our companies control that might create unsafe or undesirable travel conditions for our participants and individuals.
In such a possibility, a full refund will be issued as soon as possible. However, the financial liability of Brian Riddell Photographics shall be limited to the amount paid to Brian Riddell Photographics for the workshop.
This shall not be extended to cover any and all other related and associated travel costs incurred (e.g. non-refundable air tickets, visa fees if applicable, clothing, equipment, rentals, miscellaneous transportation costs, medical expenses, travel insurance premiums, etc.).
We reserve the right to refuse acceptance of any participant, for any reason, at any time in the process. We are not responsible for any additional expenses incurred by such participants. All tuition is based in USD.
Cancellation and Refund Policy
We understand that attending our workshops requires advance commitment, and also that things can happen in life that may require you to cancel from a workshop.
Based on the cancellation date the following apply:
· Greater than 160 days before the workshop start date: full refund of any payments made applies.
· 160-100 days before the start of the workshop: 50% refund of any payments made applies.
· 100-70 days before the start of the workshop: 25% refund of any payments made applies.
· Within 70 days of the start of the workshop: No Refund applies.
· Refunds will be paid out by the same monetary method that the original payment was made and processed.
It is noted that there are some non-refundable workshops for which the above terms do not apply, and for these workshops, we do not offer a refund of any payments made under any circumstances. This will always be noted clearly in the workshop description as “Payments for this workshop are non-refundable under any circumstances, our other Terms and Conditions apply in this situation.”
Payments made for individual private workshops that have been arranged with our company are not refundable.
Use of your Likeness
We reserve the right to take photographs/videos during the operation of any and all workshops or part thereof and to use the photography/video in whole or in part for promotional purposes, including, but not limited to advertising and publicity both in print and electronic media.
By booking a reservation with Brian Riddell Photographics participants agree to allow their images to be used in such photography. Participants who prefer that their image not be used in any form are asked to identify themselves to their tour leader at the commencement of their trip.
Unless you are already covered under an existing policy, you are required to purchase travel and medical insurance and provide this information to us prior to the workshop. This insurance should provide coverages for losses suffered in the event of trip cancellation and interruption, travel delays, possible losses of baggage and travel documents, baggage delays, possible medical emergencies, and unforeseen accidental death.
You are responsible for fully ensuring that you have the proper travel documents and required immunizations. You should check with your doctor, respective consulate(s) or visa agencies to determine whether visas are required. It is important to remember that you must have a valid passport as it is required for international travel.
You fully understand that we use third party tour organizers, transportation providers, hotel operators, and food providers to provide the services associated with the workshops. All tickets, coupons, reservations and anything related are subject to the terms and conditions and other policies of the third-party service providers.
We cannot control the actions of such third-party agents and do not assume responsibility for unanticipated events that may happen that may include, without limitation, travel delays, lost luggage, cancellations, overbooking, and other reservation errors.
You must build some flexibility into your schedule in case we need to extend the length of the workshop or make other scheduling changes to accommodate unanticipated events such as travel delays, lost luggage, cancellations, overbooking, and other reservation errors.
You will not be entitled to a refund in the event of unanticipated events requiring scheduling changes. You further agree to hold us harmless from and against any liability for injury, death, damage, loss, accident, delay or irregularity that could possibly occur in connection with any or all services provided by third parties.
